Terms of Service

These Terms of Service govern your access to and use of Photognome, a community website for visual media creators. By creating an account, signing in, browsing, uploading content, buying or using Gems, messaging other users, or otherwise using Photognome, you agree to these Terms.

You may create a Photognome account using an email/password flow or an approved social sign-in provider, such as Meta/Facebook or Instagram, where available. Social sign-in is used to authenticate your account and connect your provider identity to Photognome. Your use of a third-party sign-in provider is also governed by that provider's own terms and policies.

Photognome may refuse, suspend, or terminate accounts that violate these Terms, create safety risks, impersonate others, evade enforcement, or misuse the service.

3. The service

Photognome provides profiles, portfolios, search, messaging, casting tools, paperwork tools, QR codes, verification features, marketplace features, and a Gems-based community credit system for visual media creators. Features may change, be limited, or be discontinued over time.

4. Your content

You retain ownership of photos, videos, audio, text, portfolio materials, and other content you upload to Photognome. You grant Photognome a worldwide, non-exclusive, royalty-free license to host, store, process, display, transmit, backup and distribute your content as needed to operate, secure, promote, and improve the service, subject to the privacy and visibility settings you choose. Photognome does not have ownership over any content created by you unless you explicitly give those rights over.

You represent that you have the rights and permissions necessary to upload and share your content and that your content does not violate the rights of others or applicable law.

Photognome reserves the right to use community systems as well as AI and other software to search for restricted content. Photognome has the right to use community systems, as well as AI and other software to protect it's members.

7. Creator interactions, releases, and contracts

Photognome helps creators find and communicate with each other. Photognome is not a party to agreements, shoots, casting arrangements, releases, contracts, payments, or disputes between users unless a separate written agreement says otherwise. Built-in paperwork tools are convenience tools; users are responsible for reviewing terms, confirming identity and age, and deciding whether an arrangement is appropriate.

8. Payments and Gems

Photognome may offer purchases, subscriptions, paid features, and Gems. Gems are community credits that may be bought, earned, spent, or donated within Photognome. Gems are not legal tender, are not redeemable for cash, and have no value outside Photognome unless we expressly state otherwise.

Payment processing may be handled by third-party providers. Refunds, chargebacks, cancellations, and billing support are subject to the posted rules for the relevant feature and applicable law.

9. Moderation and enforcement

Photognome may review, restrict, remove, or refuse content; limit feature access; issue warnings; suspend accounts; terminate accounts; preserve evidence; or report conduct when we believe it is necessary to enforce these Terms, protect users, comply with law, or reduce risk to the service.

Our Privacy Policy explains what information we collect, how we use it, how social sign-in works, and how users can request data deletion. By using Photognome, you also agree to the Privacy Policy.

11. Third-party services

Photognome may link to or integrate with third-party services, including Meta/Facebook, Instagram, payment processors, email services, hosting providers, verification providers, and analytics or security services. Photognome is not responsible for third-party services, and your use of them may be governed by their own terms and policies.

12. Disclaimers

Photognome is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Photognome disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted or error-free operation.

13. Limitation of liability

To the fullest extent permitted by law, Photognome and its operators will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, revenues, goodwill, data, or opportunities arising from your use of the service.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and provide additional notice when appropriate. Continued use of Photognome after changes become effective means you accept the updated Terms.
